Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the Vibora platform ("Service"), operated by Vibora S.L. ("Vibora", "we", "our", or "us"). By creating an account or using the Service in any way, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
1. Description of the Service
Vibora is a digital platform for organising, managing, and participating in padel tournaments. The Service enables players to register for tournaments, submit and track match results, build player profiles, maintain friendships with other users, and receive notifications about tournament activity.
Vibora provides tournament formats including, but not limited to, Mexicano and Americano scheduling systems. The platform is accessible via mobile applications and through third-party integrations.
2. Account Registration and Eligibility
To access the full functionality of the Service, you must create an account. By registering, you represent and warrant that:
- You are at least 16 years of age. Persons under 16 may not register or use the Service.
- You will provide accurate, current, and complete registration information.
- You will maintain the security of your account credentials and promptly notify us of any unauthorised access.
- You are not prohibited from using the Service under any applicable law.
Registration may be performed using an email address and password, or via supported social login providers (Google, Apple, Facebook, LinkedIn). When using social login, you authorise Vibora to retrieve basic profile information from the respective provider in accordance with their terms of service and your privacy settings.
Each person may hold only one account. Accounts are personal and non-transferable.
3. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
- Impersonate any person or entity or misrepresent your affiliation with any person or entity.
- Upload, transmit, or distribute any content that is unlawful, harmful, defamatory, obscene, or otherwise objectionable.
- Attempt to gain unauthorised access to any part of the Service, or to any systems or networks connected to the Service.
- Use automated tools, bots, or scrapers to access or collect data from the Service without our express written permission.
- Interfere with or disrupt the integrity or performance of the Service.
- Manipulate match results, scores, or rankings in a dishonest manner.
- Harass, abuse, or threaten other users of the Service.
We reserve the right to suspend or terminate your account if we determine, in our sole discretion, that you have violated these Terms.
4. Tournament Participation
When you register for a tournament through the Service, you agree to:
- Participate in good faith and in accordance with the rules of the specific tournament format.
- Submit accurate match scores and results in a timely manner.
- Respect all other participants, organisers, and referees.
- Comply with any additional rules established by the tournament organiser.
Vibora acts as a platform facilitating tournament organisation and does not itself administer individual tournaments. Disputes regarding specific tournaments should be directed in the first instance to the relevant tournament organiser.
Vibora reserves the right to remove results, disqualify participants, or cancel tournaments where there is evidence of dishonest conduct or violations of these Terms.
5. User Content
The Service allows you to upload certain content, including a profile avatar. By uploading content, you grant Vibora a non-exclusive, worldwide, royalty-free licence to store, display, and use that content solely for the purpose of providing the Service to you and other users.
Profile avatars are stored on Google Cloud Storage, a cloud infrastructure service provided by Google LLC. You represent and warrant that any content you upload does not infringe the intellectual property rights, privacy rights, or other rights of any third party.
You may remove your uploaded content at any time by updating your profile. Upon account deletion, your content will be deleted in accordance with our Privacy Policy.
6. Intellectual Property
The Vibora name, logo, platform design, and all related trademarks, service marks, and trade names are the exclusive property of Vibora S.L. Nothing in these Terms grants you any right or licence to use the Vibora brand, trademarks, or intellectual property without our prior written consent.
All software, code, interfaces, text, graphics, and other materials forming part of the Service are protected by applicable intellectual property laws and remain the property of Vibora S.L. or its licensors.
7. Privacy
Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy explains how we collect, use, and protect your personal data. By using the Service, you acknowledge that you have read and understood our Privacy Policy.
8. Availability and Modifications
We strive to maintain the availability of the Service but do not guarantee that it will be uninterrupted, error-free, or free from viruses or other harmful components. We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Service or by sending a notification to the email address associated with your account. Continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.
9. Limitation of Liability
To the fullest extent permitted by applicable law, Vibora S.L. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of, or inability to use, the Service. This includes, without limitation, damages for loss of profits, data, goodwill, or other intangible losses.
Our total aggregate liability to you for any claims arising out of or related to these Terms or the Service shall not exceed the greater of (a) the amount you paid to Vibora in the twelve months preceding the claim, or (b) €50.
Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be excluded under Polish law.
10. Termination
You may terminate your account at any time by contacting us at legal@vibora.cloud or through the account deletion feature in the application. Upon termination, your right to use the Service ceases immediately.
We may suspend or terminate your account immediately, without prior notice or liability, if you breach these Terms or if we are required to do so by law. Provisions of these Terms that by their nature should survive termination shall survive, including intellectual property provisions, disclaimers, and limitations of liability.
11. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of Poland, without regard to its conflict of law principles. Any dispute arising from or relating to these Terms or the Service that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the courts of Poland.
